1) Company registration
ChinaSpeaks AG (hereinafter called ‘ChinaSpeaks’) is a limited company registered in Herisau / Switzerland and with its legal address at St. Gallerstrasse 84, 9101 Herisau / Switzerland.
2) Applicable law & Place of Jurisdiction
Any legal issue in connection to ChinaSpeaks and its services is governed exclusively by Swiss law and the place of justice is to be Zurich / Switzerland. The language of the arbitration shall be in English unless otherwise agreed.
The services of ChinaSpeaks are exclusively available to members of the ‘Staff Pool’ and for ‘Corporate Clients’.
4) Truthfulness and Liability
By signing memberships as ‘Staff Pool Member’ and/or ‘Corporate Client’ the signees confirm that all their information given is true and correct and it is understood that ChinaSpeaks is in no way responsible for any false information given by individual members.
ChinaSpeaks shall not be liable to any other 3rd party for false information given by any member, except when said acts or ommissions are due to willingness misconduct or gross negligence of ChinaSpeaks.
Any remaining liability is limited to ChinaSpeaks total income generated under the titel of such members.
5) Terms and conditions
By using the services of ChinaSpeaks and this Website, you indicate that you accept these Terms and Conditions and that you agree to abide by them. If you do not agree to these Terms and Conditions, please refrain from using the services of ChinaSpeaks respectively of this Website.
Certain content or services may be governed by special conditions which you will have to accept at the time you access such content or service.
6) Use of the Website
“You acknowledge and voluntarily and expressly accept that your use of the Website is made under your sole and exclusive responsibility.
When you use the Website you will not perform any acts that may damage our image, interests or rights or that may damage, render useless or overload the Website, or that may impede, in any way, the normal use of the Website by other visitors.
We implement reasonable security measures which are adequate to detect the existence of viruses. Nevertheless, you must be aware that the existing security measures for computer systems on the Internet are not entirely trustworthy and that, therefore, we cannot guarantee the non-existence of viruses or any other elements that may cause alterations to your computer systems (hardware and software) or to your data and files contained in your systems.”

ChinaSpeaks is committed to protecting and respecting your privacy. This Policy describes what personal data we collect from you and how we process such personal data.
Personal data we may collect from you

Where personal data is stored and processed

Upon request, ChinaSpeaks will – in compliance with applicable law – inform you as to whether personal data about you has been collected, and you may contact us to request any correction or deletion of your personal data.
Analysis of user behaviour
The internet offerings at ChinaSpeaks are tracked for the analysis of user behaviour and the identification of IP addresses for marketing purposes. The use of this service entails the direct transfer of data pertaining to user behaviour (e.g. IP address, time of access, browser searches etc.) to the servers maintained by the service provider mandated by ChinaSpeaks and their being made available for use exclusively on ChinaSpeaks. We use products of ASPKOM GmbH (www.aspkom.de) for marketing and optimization purposes. These products collect and process your personal data and use it to create usage profiles under a pseudonym. These usage profiles are fully anonymized where possible and appropriate. We and wiredminds employ cookies and/or Web beacons (also known as tracking pixels) on this website. We transfer the data we collect about you, which may also include personal data, to wiredminds or wiredminds gathers this data directly. wiredminds is entitled to use information that you leave behind by visiting our Web sites to create anonymized usage profiles. The data collected shall not be used to personally identify visitors to this website without the express permission of the party affected and shall not be merged with personal data about the bearer of the pseudonym. Any IP addresses recorded are anonymized immediately by deleting the last number block. Permission to collect and store data in the future may be revoked at any time.
